1. Service Overview
Yumi ("the App") is a virtual hair clip try-on application developed and operated by the service provider (hereinafter referred to as "we" or "us"). The App provides users with a variety of hair clip styles including broken hair clips, side clips, top clips, etc. Users can upload portrait images, and the App will generate virtual try-on effects through AI technology, and support adjusting the position and quantity of hair clips to meet personalized preview needs.
We reserve the right to adjust the service content and functional modules of the App according to technical development and business needs, and will inform users through reasonable means when major adjustments are made.
2. Account Rules
- You must be at least 13 years old to register and use the Yumi App. If you are under the age of 18, you should use the App under the supervision and guidance of your legal guardian.
- You shall provide true, accurate, complete and up-to-date information when registering an account, and shall update such information in a timely manner if there are any changes.
- You are solely responsible for keeping your account and password confidential, and shall bear all responsibilities for any activities conducted under your account.
- You shall not transfer, lend, lease, sell or otherwise dispose of your account to any third party without our written permission.
- We have the right to suspend or terminate your account if we find that your account information is false, or you violate the provisions of this Agreement or relevant laws and regulations.
3. Usage Guidelines
You agree to use the App in compliance with all applicable laws, regulations and this Agreement, and shall not engage in the following behaviors:
- Uploading, publishing or transmitting any content that violates national laws, regulations, public morality or infringes upon the legitimate rights and interests of others, including but not limited to pornographic, violent, terrorist, defamatory, infringing intellectual property rights content.
- Using the App for commercial purposes without our authorization, including but not limited to reselling the services provided by the App, or using the App to promote products or services.
- Interfering with, disrupting or attacking the normal operation of the App, including but not limited to using malicious software, viruses, etc. to invade or damage the App's system.
- Reverse engineering, decompiling, disassembling, or attempting to obtain the source code of the App in any other way.
- Other behaviors that we deem inappropriate or that violate the provisions of this Agreement.
4. Content Rights and Responsibilities
You retain the ownership of the portrait images and other content you upload to the App. By uploading content to the App, you grant us a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use, reproduce, modify, adapt, publish, translate, distribute and display such content for the purpose of providing and improving the App's services.
You shall ensure that the content you upload does not infringe upon the intellectual property rights, portrait rights, privacy rights and other legitimate rights and interests of any third party, and shall bear all legal liabilities arising therefrom.
We have the right to review the content uploaded by you, and may delete or block any content that violates laws, regulations or this Agreement without prior notice.
All intellectual property rights of the App itself (including but not limited to software, trademarks, copyrights, patents, trade secrets, etc.) belong to us or our licensors. You shall not use such intellectual property rights without our written permission.
5. Payment Terms
- Some features of the App may be provided on a paid basis ("Paid Services"). The pricing and payment methods of Paid Services will be clearly displayed on the relevant pages of the App.
- You shall pay the corresponding fees in accordance with the payment methods specified by us when using Paid Services. All fees are non-refundable unless otherwise stipulated by law or agreed by us.
- We reserve the right to adjust the pricing of Paid Services, and will inform you of such adjustments in advance through the App or other reasonable means. If you continue to use the Paid Services after the price adjustment, it shall be deemed that you accept the new pricing.
- You shall be responsible for all taxes (if any) arising from your use of Paid Services.
6. Service Modification and Termination
We may modify, suspend or terminate all or part of the App's services at any time for technical adjustment, business development or other legitimate reasons, and will try our best to notify you in advance through the App, email or other means.
You may terminate your use of the App at any time by logging out of your account or deleting the App. If you violate the provisions of this Agreement, we have the right to suspend or terminate your use of the App at any time without prior notice.
Upon termination of the service, your right to use the App will immediately cease, and we will not be liable to you or any third party for any direct or indirect losses arising therefrom, except as otherwise stipulated by law.
7. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. WE SHALL NOT BE LIABLE FOR ANY INACCURACY OR ERROR OF THE VIRTUAL TRY-ON EFFECT GENERATED BY THE AI TECHNOLOGY.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA OR GOODWILL.
8. Dispute Resolution
Any dispute or claim arising out of or in connection with this Agreement or your use of the App shall first be resolved through friendly negotiation between you and us.
If the negotiation fails, either party may submit the dispute to the people's court with jurisdiction over the place where we are located for litigation.
This Agreement shall be governed by and construed in accordance with the laws of the People's Republic of China (excluding conflict of laws principles).
9. Agreement Updates
We may update this Agreement from time to time in accordance with changes in laws, regulations or business needs. The updated Agreement will be posted on the App, and the effective date will be indicated.
Your continued use of the App after the updated Agreement takes effect shall be deemed your acceptance of the updated Agreement. If you do not accept the updated Agreement, you shall stop using the App immediately.
